The following text is a public offer ("Agreement") from LLC "WORKINS LTD UKRAINE" ("WORKINS") with a proposal to enter into a contract for the provision of personnel selection services and the use of an online CRM system for recruitment. By accepting the conditions set forth below, the customer is deemed to have accepted this public offer and agrees to enter into an Agreement for the provision of the specified services.
Definitions 1.1. Customer - any legal or natural person who places an order for the provision of personnel selection services and the use of an online CRM system for recruitment by entering into an Agreement with WORKINS.
1.2. WORKINS - LLC "WORKINS LTD UKRAINE," a legal entity registered in Ukraine at the following address: 35400, Rivne region, Hoshcha district, Goshcha village, Zastavya street, building 1, with EDRPOU code 42070342.
1.3. Services - the services provided by WORKINS for personnel selection and the use of an online CRM system for recruitment.
Subject of the Agreement 2.1. Within the framework of this Agreement, WORKINS undertakes to provide the Customer with personnel selection services and the use of an online CRM system for recruitment. Data on job candidates and clients are stored in the database of LLC "WORKINS LTD UKRAINE."
2.2. Personnel selection includes the following services:
2.2.1. Analysis of the Customer's needs and preparation of a job vacancy profile. 2.2.2. Placement of job vacancies on relevant platforms and advertising channels.
2.2.2. Posting job vacancies on relevant platforms and advertising channels.
2.2.3. Conducting candidate selection, including assessing their qualifications, conducting interviews, and checking references.
2.2.4. Preparing and sending the client resumes of selected candidates.
2.2.5. Organizing meetings between the client and suitable candidates.
2.2.6. Assisting in the preparation of an employment contract between the client and the selected candidate.
2.2.7. Providing regular updates and reports on the recruitment progress to the Client.
2.2.8. Assisting the Client in negotiations and finalizing employment contracts with selected candidates.
2.3. The use of the online CRM system for recruitment includes:
2.3.1. Providing the Client with access to the CRM system, where data on candidates and clients are stored.
2.3.2. The ability to create, edit, and delete records of candidates and clients.
2.3.3. Storing information about vacancies, contact details of candidates, and other important data.
2.3.4. Ensuring the security and confidentiality of data.
Cost and Payment
3.1. The cost of providing recruitment and online CRM system services is determined by mutual agreement between WORKINS and the Client. The cost may be based on various factors such as the scope of work, complexity of vacancies, duration of the contract, and others.
3.2. Payment for the services is made by the Client within the agreed terms and procedures, according to the agreement concluded between the parties. Payments can be made by bank transfer to WORKINS' bank account or by other convenient methods specified in the contract.
Confidentiality
4.1. The parties undertake to maintain confidentiality and not disclose any information relating to the business or commercial secrets of the other party that they have obtained under this Agreement.
4.2. The use and processing of personal data of candidates and clients are carried out in accordance with the applicable legislation on personal data protection and WORKINS' privacy policy. The Client agrees to such use and processing of personal data.
Liability
5.1. WORKINS shall not be liable for any damages that may arise from the use of the services or reliance on the provided information.
5.2. The Client is fully responsible for the accuracy and timeliness of the information provided regarding vacancies, candidates, and clients. WORKINS shall not be liable for any consequences arising from the use of inaccurate or outdated information.
5.3. In case of the Client's breach of any obligations stipulated in this Agreement, WORKINS reserves the right to terminate the provision of services and demand compensation for the damages caused by such breach.
Term and Termination of the Agreement
6.1. This Agreement shall enter into force upon its acceptance by the Client and shall remain in effect until the parties have fully performed their obligations under the terms of the Agreement.
6.2. Each party has the right to unilaterally terminate the Agreement by notifying the other party in writing at least 30 days prior to the desired termination date.
Final Provisions
7.1. This Agreement is legally binding for both parties from the moment of its acceptance by the Client.
7.2. Any changes and amendments to this Agreement may be made only with the written consent of both parties.
7.3. All disputes and discrepancies arising from this Agreement shall be resolved through negotiations between the parties. In case of failure to reach an agreement, the disputes may be referred to the court in accordance with the legislation of Ukraine.
This Agreement-Offer is considered concluded from the moment of its acceptance by the Client.
